Texas Name Change Petitions Must Satisfy the Requirements of Section 45 of the Texas Family Code

A recent decision by the Texas Court of Appeals for the Seventh District (Amarillo) underscores how important it is for name change applicants to provide all of the information required by the Texas Family Code. In a recent published decision, the court denied petitioner’s name change petition because petitioner failed to set forth whether or not he had complied with the Family Code provisions applicable to petitioners with prior felony convictions.

In Texas, the forms that are required for both adult and child name change petitions are straightforward. Chapter 45 of the Texas Family Code governs petitions for change of name of children and adults. For adults, the verified petition requirements include, among other things, a statement of whether the petitioner has been convicted of a felony. Notably, in Texas, a felony conviction does not preclude someone from changing there name. Where a petitioner has been convicted of a felony, a Texas court may a permit the requested name change provided that the petitioner establishes that he has: (a) received a certificate of discharge by the Pardons and Paroles Division of the Texas Department of Criminal Justice; or (b) completed a period of probation ordered by a court and not less than two years have passed from the date of the receipt of discharge or completion of probation; or (c) been pardoned. These requirements are set forth in the Texas Family Code, Section 45.103(b).

Although individuals with felony convictions may encounter greater scrutiny in the name change process, their petitions may be granted if they establish, in their petitions, compliance with the foregoing requirements of Section 45.103(b).

For persons who do not have felony convictions, the courts in Texas are usually quite accommodating with regard to name change requests. An application for a change of name by an adult is controlled by subchapter B of Chapter 45 of the Texas Family Code. Section 45.102 sets out the requirements of a petition requesting a change of name. The petition must include (1) the present name and place of residence of the petitioner; (2) the full name requested by the petitioner; (3) the reason the change in name is requested; and (4) a statement whether the petitioner has been the subject of a final felony conviction. Tex. Fam. Code Ann., Section 45.102.

Texas’ liberal approach to name change petitions is set forth in the Family Code, which states that “the court shall order a change of name under this subchapter for a person other than a person with a final felony conviction if the change is in the interest or to the benefit of the petitioner and in the interest of the public.”

Given the permissive approach toward name change that is set forth in the Texas Family Code, it is not surprising that if a name change petition includes all of the required information, it is likely to be granted. What is Lent?

March 8, 2011. Lent is the 40 days before Easter during which Christians prepare for the Passion, Death and Resurrection of Jesus. It’s meant to remember the 40 days Jesus spent in the desert preparing himself for public preaching. It begins on Ash Wednesday, when a priest places ashes on the head or forehead of Catholics and invites them repent. The ashes come from the olive branches that were blessed on Palm Sunday from the previous year. Every Friday of Lent, the Catholic Church asks everyone to not eat meat as a sign of penance. They also hold a fast on Ash Wednesday and Good Friday. The Church also urges Christians to practice other forms of piety such as giving alms, making a pilgrimage or any other willful deprivation to prepare for Easter. We are at the beginning of Lent: a time of penance, purification and conversion. It is not an easy program, but then Christianity is not an easy way of life. It is not enough just to be in the Church, letting the years roll by. In our life, in the life of Christians, our first conversion — that unique moment which each of us remembers, when we clearly understood everything the Lord was asking of us — is certainly very significant. But the later conversions are even more important, and they are increasingly demanding. To facilitate the work of grace in these conversions, we need to keep our soul young; we have to call upon our Lord, know how to listen to him and, having found out what has gone wrong, know how to ask his pardon

Is a Name Change Cheaper Than Pardoning a Criminal Record?

It is no secret that having a conviction carries significant restrictions for the bearer and that at any point in their life, a prospective employer may turn them down or they may lose some other opportunity due to the conviction turning up on a background check. At least in Canada, one way of dealing with this problem is to apply to the Parole Board of Canada to pardon a criminal record (it will not be erased, but the Canadian Police Information Centre (CPIC), which records criminal convictions in Canada, will make it inaccessible, causing background checks to turn up clear. But getting a pardon for a criminal record is not automatic: first, before a person can apply to get one, a period of ineligibility of three to ten years (depending on the gravity of the conviction) starting upon the completion of one’s sentence must pass. The application process involves the Parole Board of Canada and is itself lengthy and fraught with bureaucratic difficulty. Moreover, even a pardoned criminal record is flagged in the CPIC database in the case of certain violent and sexual offenders and may be disclosed on a background check if the applicant wishes to work with vulnerable sector people like children. Is there any other option for a person wishing to hide the fact that they have a conviction?

Name Changes

In the past, one apparently simple solution was for an ex-convict to change their name and to apply under that name for a background check when required to do so. Following the recent media coverage of Graham James, the hockey coach who sexually abused NHL players Sheldon Kennedy and Theo Fleury as teenagers, was convicted, served a short sentence, was pardoned, and recently was charged with further sexual abuse, a CPIC superintendent stated that in many cases, the name change tactic is successful. The exact rules for doing so vary from province to province, but at present, only British Columbia and Alberta require fingerprints when applying for the name change. Once a change is approved, it is published in official gazettes, but is not formally relayed to the CPIC. As a result, many have gotten away with the ruse and have made it look like they have no record whereas in actual fact, they do. This would only be discovered if the person in question were charged with a fresh offence, in which case they would be fingerprinted, the prints matched with those already existing in the database, and the new alias added to their record.

Similarly, if a single woman with a criminal record gets married and formally changes her name to her husband’s, the criminal record will stay under her maiden name and an application for a background check made under her new name should result in no matches.

More Transparency May Be Imminent

However, provincial name-change procedures provide different levels of disclosure, and the name change may be picked up by the RCMP. The system in British Columbia seems to be the most transparent, with applicants being required to provide fingerprints taken by a police department or accredited agency; after the name change is registered, these prints are sent to the RCMP for a background check. Similarly, in Alberta, name change applicants are subjected to an RCMP fingerprint screening. In other provinces, the name change process may be hampered by such requirements as that the request not be for fraudulent purposes. On top of that, the CPIC is making attempts to identify more offenders by matching applicants’ birthdates, genders and fingerprints, rather than just names, with those in the database. With the recent crackdown on crime by the Canadian government, there is a chance that more provinces will adopt a system similar to British Columbia’s. So, the only certain way to make one’s criminal past inaccessible to the public is to have the Parole Board pardon a criminal record.

Change Affects Business and Profits – A Look at Pardons Vs Record Suspensions

If a company designs its business around a particular product and creates logos, sales items, signs, ads, websites, etc around this product, will changing the name of the product affect the profit of the business?

Let’s look at a current event in Canada as an example. For the last 40 years, anyone who knew they would not pass a criminal record check could apply for a pardon, and based on certain criteria, the request was granted. Many businesses were built around this process, and for the sake of effective branding, they all have the word “pardon” or “pardons” in their business name. Over the last few months however, the government has been looking at changing the pardons process in Canada. The first of their changes will be to switch the term “pardon” to “record suspension.” Let’s look at how this will affect the many businesses that have built a company name around the word pardon.

There are a few changes that would have to be made immediately following the passing of the new laws concerning pardons:

Companies would have to change their business names.
All online and print ads would need to be changed.
Companies would have to print new flyers, business cards, posters etc.
They would have to change the name of their website(s).

These changes would each have an adverse affect on any business; there is room for certain changes to have a positive effect, but the reality is that the pardons businesses will lose profits. First of all, these companies will have to pay for each of the above mentioned four changes to their business. Changing a business name means ordering a new sign, when the old one could have lasted a few years.

Modifying any online or print ads would cost the least amount of money, as prices usually remain the same, and it only takes a phone call or an email to make the change. The third adjustment could cost quite a bit, depending on how much the company has already paid for their flyers and business cards. If for example, a company just paid a few thousand dollars for a flyer campaign, they would now have to pay that money all over again for re-printed flyers that replace pardons with record suspensions, as well as replace the old business name.

Changing a pardon website to a record suspension website would be relatively easy, but the company would still have to pay for the hours spent re-vamping the old website. The smart thing to do would be to buy a new URL with the correct term “record suspensions” and simply re-direct the URL to the old website. However, they would still need to re-write their web content, re-format buttons and headings, and basically change anything that still talks about pardons.

The new pardons law is in its second reading in parliament, and will most likely be passed in the next few months. Unfortunately, many companies will find the change to be a negative impact on their profit margin, but the good news is that it will only be a short term loss, and all of the competition will be suffering at the same time.

You heard right. Move away from your computer keyboard, take some paper out of the printer and locate a pen.

It is really kind of magical! By setting pen to paper we use a different part of the brain as well as the portion used for listening. This provides a kind of back link which strengthens the process through which information is stored in our memories.

For this reason, if you write something down you are quite likely going to remember it, and strangely, have less need to take a look back over your notes.

Don’t try to stare someone in the eye and write at the same time. It won’t work and your prospect will probably be hoping to look down to see what you might have on the paper! Just look up once in a while. You don’t need to write down all that you hear, but catch important key phrases.

Tell your prospect you will be taking notes to help you to remember what they are saying. Even if they can’t see you, when they’re on the phone, most will like the fact that you’re taking them seriously enough to make a record of what they say.

Already, you will see your prospect relax a bit. They will begin to suspect that maybe, just maybe you will not be going to slam them with a sales pitch. They might begin to think: Can it be that this person is truly interested in me?

Network Marketing Tip #2: Write Down Their Story

You’ve gotten to this point because you have requested a meeting. You’ve asked for your prospect’s time. But NEVER, EVER begin with your solution, your system, your whatever!

And so exactly where can you begin? By always keeping in mind that this is the prospect’s time and they’re in complete control of how things go next. The prospect is the lion in the room.

Right now, they have all the power on their side. Of course, if you smart – which I’m certain you are – you’ll know that at almost any second they might elect to say “No” and you’re done.

Just about everyone has had this experience. You launch into your spiel and suddenly, your prospect is out the door.

This leaves plenty of people wondering why the content presented in the coaching workshop, or back-office video or the DVD didn’t work here. You might even have it memorized word for word! Just what went awry?

You didn’t remember the reality that the lion in the room is the prospect – NOT YOU. And what occurs? He will either have you for supper or get up and stroll off back to whatever lions do.

What exactly do you do? Start by saying something like:

I’m prepared to talk about _____ , but first, could you give me your perspective? That way, we can focus on what interests you.

You can substitute terms like “thoughts,” “ideas,” or “viewpoint.” However keep it neutral. Keep a respectful distance. The lion will not let you near enough yet to get a look at any “problem” or “challenge.”

By just coaxing out their story you obtain a powerful advantage. Free of charge, you gain access to precisely what matters to them, why it matters and how it came to matter. You could possibly even get the “when” and the “where” mixed in as well. The bottomline is, you’re able to go back into their past.

It’s the past that’s the determining factor for the prospect at this point. Your solution, product, system is still some time in the future. Since it’s still in the future, it has got no validity for them.

Network Marketing Tip #3: Ask More Open Ended Questions

Asking one question is just the start. You will need to keep asking open ended questions and taking notes. Questions like:

Tell me more about . . .

Give me an example of . . .

What else should I know about . . .

What else would help me understand . . .

How do you handle ________?

O.k., you may be thinking, this sounds very nice but isn’t it a waste of time? Do I get to talk? Do I get to inform them about my solution to their problem?

“NO” to all 3 questions. Not right now. Until you completely understand and can supply them with real proof that you understand, your prospect is stuck in the past. You can help them get unstuck but that will come later on.

Right now, as you continue to ask questions several important things are happening.

First, they are committing a valuable resource – their time – in you. The more time they invest, the more probable it is that you can make the sale. Not one minute has been wasted here.

Second, you are helping them to think through or process the past. By just asking the right questions you are helping them complete the scenario in a process of discovery. You are able to help them understand something which may not have been revealed before.

Does this sound like sales therapy to you? Great. You are spot on! At this point, apply the 80/20 rule. 80% of the time your prospect should be talking and you have the remaining 20% or less.

Third, you’re proving that you’re a person that can be trusted. Why? Because you told them that the time would be devoted to what interests them and you are adhering to your promise.

I’m sure you can begin to see how this changes the entire dynamic to your advantage. Does it take time? Does it take practice? Sure it does. Anything worth doing, from playing a guitar to being a doctor, takes practice.
