Criminal Record Expungement – Can Even Serious Charges Be Expunged From Your Criminal Record?

Does the severity of the charge against you affect your chances of success in the Florida expungement process? For example, does it make a difference whether you were arrested for simple battery, or, let’s say…murder? According to Florida law, and unlike many other states, the answer is no. A Florida court is not allowed to deny your request to expunge your criminal record simply due to the seriousness of your arrest charges.

One of the statutory eligibility requirements for Florida expungement is that the charges against you were dropped, dismissed, or never filed. So it does not matter what you were arrested for, so long as at some point during the process, either the court or the prosecutor determined not to proceed against you (either due to lack of evidence or for some other reason). If you meet all other eligibility requirements, the seriousness of your arrest charge will not prevent you from expunging your criminal record in Florida.

If the seriousness of the charge alone is not sufficient to deny a Florida expungement request, how about record sealing? Eligibility for record sealing is determined under a different Florida statute, and not the Florida expungement statute. One of the eligibility requirements to seal a criminal record in Florida is that you must have received a withholding of adjudication on a guilty or no contest plea. In order to qualify, you cannot have been convicted (“adjudicated guilty”) by the court.

In practice, it is less likely that you will receive an adjudication withheld on a more serious charge, although it is still possible (and it helps if you have a good attorney!). But even if you do, the Florida statutes contain a list of “ineligible offenses” that you cannot have sealed, under any circumstances, even if you did receive a withheld adjudication. Some of these crimes include many of the sex crimes, kidnapping, aggravated battery, aggravated assault, robbery, domestic violence arrests, etc. Typically crimes involving excessive violence or harm to an individual are included on the ineligible offenses list.

So while the seriousness of a charge does not matter in terms of Florida expungement, it can make a difference in a record sealing request. Question by mrmoran_2000: I have completed all the forms for my expungement in Illinois?
but I am stuck on who to send them to. I need to file at the 3rd district (Rolling Meadows) so I have addressed to the states attorney at the rolling meadows courthouse. The arresting agency was the Norridge Police Dept and Illinois State Police is already pre-filled and the 4th says “Chief Legal Officer of the unit of local government that arrested you”: HELP – I do not know who this is or what address to put down! Where do I locate this information??? Please help.

Pardoned From Unforgiveness

“Why are you still talking about forgiveness? That may be something you are asking. These walls not only keep us trapped inside, others shut out, but also these walls keep God’s best from being poured out in our lives. These same walls are what can prevent us from living out destiny. We must forgive those that have hurt us and get all the resentment, bitterness, and anger out of our lives. See folk in a totally new and refreshing way; forgive. I believe in you and encourage you to start today. You are too awesome to in the prison of unforgiveness. I pardon you today!

We Have a Most Gracious Powerful and Loving God Who Sets People Free From Sin – Sins and Addictions

Almighty God has given us the waters from which we are to drink, and through Jesus Christ, our loving gracious God has provided us with the Bread of Life. It is all there is Christ Jesus so there is no need to battle and struggle, and yet man does struggle with all this he can at times find it so hard.

The invitation is to you, and what we do with the invitations which God gives is our responsibility. This is where strong clear courageous leadership is so vital and so needed.

I have been reading and studying the prophetic words of that amazing leader, Isaiah. God poured His truth into him and Isaiah poured it out for our edification and instruction and blessing. These thoughts emerge from Chapter 55 in Isaiah’s prophetic book.

God is saying, “Listen and listen to Me, and eat what is good”. Some people do not believe or realise that what God has for them is good. He has not one bad thing to give them.

Listen with a listening ear, wanting to hear from God, and wanting to believe what God has to say, and not to miss it. Listen, waiting to accept what the risen and living Jesus has to say through the Holy Spirit.

Listen to me. That might be regarded as some as arrogance, but not so.

You will be satisfied. This richest of fare won’t make you overweight, nor will this drink harm you in any way. You can drink what Jesus offers you and never go over the limit.

Verse 3 has such simple words of one syllable. It is astonishing how simple Isaiah makes God’s holy word at times.

Isaiah goes on to speak to the people of Israel, reminding them of who they are and what He is going to do, and He speaks too about the influence they are about to have.

All this came so very true in and through Jesus Christ, some six hundred years later. It was a long wait, but it was certainly worth it.

In verse 6, Isaiah issues a word of command that has blessed thousands over the years.

We cannot find Jesus just when we want to, or when we decide.

There comes that moment when Jesus calls, or when God draws near, or when God speaks, and when the Holy Spirit moves. Our response is, “Come Jesus and save me and rescue me and deal with me and forgive my sins and fill me with the Holy Spirit.”

There has to be a calling in some shape or form, and that might mean losing your dignity. Is it not better to lose your dignity for a very brief period and thereafter to know that you are spiritually secure and safe in Christ?

In verse 7, Isaiah is so clear and specific, and he spells it out in such detail. “Let the wicked forsake he way and the evil man his thoughts.” There has to be this turning to the Lord, and the response and reaction and consequence is that He will have mercy on that man who turns to Almighty God, for He will freely pardon. The words could not be simpler. The instructions could not be more simple or straightforward. Yet, people struggle with this.

All tied up in this too is deliverance and it can involve deliverance and being released and set free from some addiction. Clinics can be exceedingly expensive and it is possible to be set free through Jesus Christ without money and without price.

Do read the whole Chapter. It could prevent you from wasting thousands of dollars and pounds!

The order is, turn to God, and receive mercy and pardon. Check it out. These are real riches.

Here in Isaiah is the clear notion of repenting and turning around, and beginning to walk in a different direction. Then, we can walk in the light of God and be released from sin and darkness and fear and some debilitating addiction.

We have a gracious loving powerful God and He does not tease!

Distinguishing Misdemeanors From Felonies

Felonies and Misdemeanors

As a United States citizen, you should familiarize yourself with our legal system. By doing so, you will know what acts are considered illegal and how you will be punished if you commit any of them.  Having a fundamental knowledge of this information is also crucial to understanding your rights and freedoms, as well as how our country is run in general.

In the US, there are two classifications of criminal actions: felonies and misdemeanors. They are formally distinguished by the amount of punishment that accompanies each one; misdemeanors are penalized by up to one year in prison while felonies are penalized by a prison sentence of one year or more. However, they are also set apart by the fact that misdemeanors are generally considered to be lesser criminal actions while felonies are graver illicit acts.


As mentioned, misdemeanors are considered to be lesser criminal actions. Even though they are not as serious as other crimes, however, they will still go on your criminal record and they will not go unpunished.  Depending on the charge, a misdemeanor can prevent someone from being accepted into school, from receiving a loan, from renting an apartment, or from getting a job.

While misdemeanor classifications vary from state to state, the following are typically considered to be misdemeanant actions:

·         Public intoxication

·         Petty theft

·         Prostitution

·         Disorderly conduct

·         Vandalism

·         DUI

·         Drug possession

Misdemeanors are further subcategorized depending on severity. Again, this is done so by the state. Therefore, a crime holding much weight in Texas, for example, may not be considered as severe in a different state, like Illinois.


As opposed to misdemeanors, felonies are considered to be much more serious criminal acts. Offenders face at least one year in jail, although the worst felonies may be punished by life in prison or even death, if the state supports capital punishment. Those convicted of felonious actions will also face much steeper fines. 

Again, like misdemeanors, felonies are classified on a state-by-state basis. However, the following are almost always considered felonious:

·         Grant theft

·         Robbery

·         Rape

·         Aggravated assault and battery

·         Murder

Jennifer Petkov Arraigned in court: Up to 4 years in prison; loss of kids and being a felon. Ouch!

A woman who has gained worldwide notoriety for tormenting a 7-year-old girl dying of Huntington’s disease and her family was arraigned Friday afternoon in 33rd District Court on charges of felonious assault and reckless driving. If convicted of felonious assault, Jennifer Petkov, 33, of Trenton could face up to four years in prison. The charge of reckless driving is a misdemeanor and carries a sentence of up to 93 days in jail. Petkov is accused of trying to run over a neighbor at about 4:25 pm Wednesday as the woman was crossing the street in the 200 block of Detroit. Thirty-third District Judge Michael McNally set Petkov’s bond at 000/10 percent and scheduled a preliminary examination of the evidence against her for 8:30 am Oct. 26. Petkov’s attorney, Scott Weinberg, asked for a personal bond. He said Petkov is the mother of four children, is not a flight risk and has no criminal convictions. Trenton police Detective Sgt. James Smellie confirmed that there are no criminal convictions on Petkov’s record. He said, however, that police have had many incidents with her and she is on probation for a disorderly conduct charge. Smellie said there has been an ongoing feud between Petkov and a neighbor and it is escalating. The driving incident was witnessed by two people. Police were told that Petkov was in a red Impala in her driveway, with the vehicle facing the street. The witnesses said Petkov then attempted to run over the woman as she was crossing the street. The Latest Silliness and Insanity From Our Political Class

If you follow our political class and their inane actions and antics long enough and close enough, you are continually amazed about what they do and how much time, resources, and taxpayer money they waste without ever really accomplishing anything worthwhile. Their actions range from just outright waste to wasting time on issues and topics that have very little to do with the average American’s daily life. Consider some of the latest examples:

– Outgoing Governor Charlie Crist of Florida just got whooped in his bid to become the next U.S. Senator from Florida. This has caused him to be out of the office a lot lately while the Florida economy continued to be a basket case with high unemployment, high foreclosure rates on homes, and no immediate prospects for an economic upturn. Florida schools, while improved, are still not where they should be. Thus, now that he is back to being a full time Governor with limited time in office, one would have hoped he could have finished out his terms vigorously on some of these major issues.

No chance. According to an Associated Press article on November 17, 2010, Governor Crist has decided he wants to work on getting a state pardon for Jim Morrison of the Doors, who was convicted of exposing himself at a concert in Miami 41 years ago. Mr. Morrison died in Paris 39 years ago. According to the article the Governor will need the support of at least two Cabinet members and even then it might be a problem to pardon a dead guy from almost 40 years ago because the state has no procedures and law in place to do so. Talk about a waste of time and effort, does anyone, anywhere really think this is a pressing issue except for Mr. Crist?

– According to a short blurb in the November 12, 2010 issue of The Week magazine, California Governor Arnold Schwarzenegger has recently banned the use of state government-issued welfare debit cards at psychics, medical marijuana shops, bingo parlors, tattoo parlors, and cruise lines, all of which have shown up as locations where welfare recipients are spending the state taxpayer dollars. I think it is a great idea that the Governor is shutting down this gross misuse of taxpayer dollars but why was this behavior not forbidden from the first day the debit cards were issued? A rational human being would have initially restricted the use of the cards to food stores, medical establishments, clothes stores, etc.

– This example falls into that wonderful category of: “Why didn’t they do the math upfront?” Federal Reserve Chairman Ben Bernanke spoke to Senators today to explain his plan for printing about $ 600 billion of U.S. money to buy back Treasury notes from the public domain in an attempt to lower interest rates, resulting in more economic growth and more employment.

He told the Senators that his plan would result in 700,000 new jobs created over the next two years. Let’s do the math: the Chairman is going to flood $ 600 billion into the market and create 700,000 jobs which comes out to about $ 857,000 to create a single job. Hardly sounds like an efficient way to create jobs. Last I saw was that there were about 14 million unemployed Americans so at this rate the Chairman would have to float about $ 12 TRILLION to get everyone a job, which is a ridiculous idea and number.

But this type of silly thinking is not much different than the Obama administration job claims. It claimed to have created over 3 million jobs by implementing its $ 800 billion stimulus program. However, more simple division shows that the $ 800 billion total program cost resulted a per job created cost of over $ 250,000. Don’t these people in Washington ever to the math?

– With the Federal government spending out of control and the national debt skyrocketing, one would have hoped that sanity would prevail and that the Feds would be looking for non-painful ways to cut spending. That does not appear to be the case, at least according to a Heritage Foundation report from October 4, 2010, a report that cited the New York Times as its source. According to their information, the Federal government’s National Science Foundation will award $ 700,000 of taxpayer money to a New York theater troupe to produce and stage a show entitled “The Great Immensity” which will look into “the emotional and psychological aspects of the current environmental crisis,” i.e. global warming. Number of insanity aspects to this action:

First, the Foundation was founded in 1950 “to promote the progress of science, to advance the national health, prosperity and welfare, and to secure the national defense.” Personally, I find it difficult to connect their charter to a local play about global warming. As did the New York Times which called the grant a rare gift, recognizing that the Foundation usually funds research that involves math, science and engineering, not emotional and psychological aspects of anything.
Second, while many think global warming is a man made problem, many others do not hold that belief. The article cites experts that would dispute the notion of global warming. Would not this money have been better spent in hard science areas to actually get more proof, one way or another, on what the root cause of the problem is and what possible solutions are out there?
Rather than fund local plays that will be seen by very few people and have an impact on even fewer, would not this money have been better spent to reduce taxes, pay down the national debt, hire a few more good teachers, treat a few more drug addict Americans? The Federal government should not be in the theater subsidy business.

– Staying in the area of global warming, consider an article on the rash of new electric car models that will be hitting markets around the world soon. In a review of these new models and their impact on the environment, an article in the October 9, 2010 issue of The Economist magazine worried that although the electric cars would reduce harmful emissions, those reductions might be offset by the additional fossil fuels that would have to be burned to create the electricity that runs the new electric cars.

Skeptics quoted in the article doubted that the electric cars would have much of an impact at all and would waste taxpayer money in the subsidies the political classes in all countries are throwing at, and possibly wasting, on electric care purchases. The article quotes Richard Pike’s work as chief executive of the Royal Society of Chemistry. He estimated that replacing all of Britain’s cars with subsidized electric cars, and using Great Britain’s current electric generation fuel mix, would cost 150 billion British pounds and would reduce carbon emissions by only 2%. With that subsidy money, according to Mr. Pike, Britain could replace its entire power generation capacity with solar cells and cut carbon emissions by one third.

Is Mr. Pike correct in his analysis? I have no idea but given his position in the science world, would not it be a good idea to take a comprehensive look at the value of electric cars in general and the value of their subsidies? A 2% reduction in carbon emissions vs. a 30% reduction certainly merits a little better subsidy legislating beforehand, i.e. do the math first.

– A Wall Street article by Jonah Lehrer was summarized in the November 12, issue of The Week magazine and was entitled: “Proof That Pundits Are Clueless.” The main thrust of the article was that the future is impossible to predict. It cites a long term University of California study that actually monitored the predictions of pundits and experts in a variety of fields. Of the 82,000 predictions from the experts that the study documented and tracked, the accuracy rate was below 50%. In other words, a simple coin flipping decision process probably would have done a better job than what the experts predicted. The study found that the results were consistently bad across the political spectrum and the most famous experts were usually the worst predictors. Thus, given this study’s results, one needs to be very skeptical when a Federal Reserve chairman tells you that his actions will create 700,000 jobs or a President tells you that unemployment will never go above 8% if his economic stimulus package is passed, or an economist tells you they know the future when very few of them, along with our politicians, never saw the coming of the “Great Recession” until it smacked them in the face.

– And finally, some very sad and serious insanity. According to an article in the Chronicle Of Higher Education that was summarized in the November 12, 2010 issue of The Week magazine, in the United States more than 5,000 janitors and more than 8,000 waiters and waitresses have earned Ph.Ds or the equivalent before settling into their current job. In total, 17 million working Americans have received college degrees but are employed in jobs that do not require a bachelor’s degree. What a waste. We have allowed the political class to steer us into an economic situation where millions of people are not using their full capabilities, capabilities that could find cures for diseases, make factories more efficient, teach our kids better, invent better products and services, etc.

Funny, sad, wasteful, ridiculous, you pick your own adjective to describe this behavior. We need to establish a number of rigid steps and procedures regarding the activities and priorities of our political class including the implementation of term limits, holding Congressional committee members accountable for their errors, oversights, and missteps, and reduce the size of government in order to get our politicians focused on a smaller, but more important, set of priorities. These steps would help eliminate some of these inane acts of our politicians.

However, we need to do a better job as an electorate in selecting capable candidates who are smart, problem solving oriented, and courageous enough to take unpopular stands, even if it might harm their political career. We should not accept people in office that actually want a political career, we need people in office who want a leadership career.

The immaturity, and pure foolishness of some the responses leave me wondering why some of the persons even bothered to stroke the keys to type something.

It’s been like a flippin Jerry Springer episode here. One of my posts, “Tired of the princess fantasy and I quit.” got many good responses, however for some reason the good, well thought out posts hardly got any attention from voters. Please go see for yourself.

This poster, ju1244, didn’t even bother commenting on the validity or content of my post, she just attacked me. This venomous, unproductive, unneeded, unwanted and completely asanine response is the social equivalent of pulling ones pants down at a dinner party.

Here’s the part that kills me, the unsilent community had the, pardon the expression, guts to applaud it by voting it number one!!

Honestly ju1244, a little leven ruins the entire pound of flour. You don’t know me from your next door neighbors podiatrist, and you make smart assed comments like this? For the love Pete, don’t expose yourself like this, please.
