Significant Grounds to Consider to Qualify For Pardon in Canada

Any person with a criminal conviction in Canada not considering their immigration standing may submit an application for a Canadian pardon for 1 or more of their offenses once 3 to 5 years have passed (Criminal Records Act). Pardons are granted by the National Parole Board. A pardon does not signify that a criminal document was deleted though it will be taken out of the Canadian Police Information Centre (CPIC) and your criminal evidence will not be manifested on any checks of the communal records in Canada, which means that individuals with pardoned sentences will not be singled-out when they apply for a career or for a slot in the Canadian Forces or federal authority agencies. The Solicitor General of Canada always holds the capacity to divulge information on past crimes despite of your pardon.

It is not necessary to be a Canadian local or permanent dweller to apply for a pardon in Canada. It is also viable to qualify for pardon if the sentenced individual was executed to a crime committed in other territory and has been relocated to Canada under the Transfer of Offenders Act. It is not compulsory to apply for a pardon if a criminal record consists an unconditional or indefinite freedom. Ever since July 1992, criminal proceedings of this kind are automatically removed from the CPIC database one year after a total freedom had been established and three years for a restricted discharge. The RCMP must be contacted directly to erase convictions committed preceding July 1992.

For summary offences, three years must elapse from the day all charges, costs and damages were paid and all jails or community services, try-out orders and parole periods were completed. For indictable offences and those citizens who meet the criteria under the Transfer of Offenders Act the period is five years. If they have completed more than 6 months in prison or were penalized more than two thousand dollars or if they were discharged from the Canadian military or police, nationals found guilty for provisions found in the National Defence Act should also wait 5 years. All other National Defence penalized applicants should wait three years before applying.

Pardon hopefuls must show that they have lived as law-abiding persons over the mandatory three to five year period. The National Parole Board confers with a number of agencies including law imposing agencies like the Royal Canadian Mounted Police (RCMP) who notifies not only the convictions but also the alleged or suspected criminal activities. The National Parole Board also takes into account private accusations, providing there is more than one, in opposition to a person applying for a pardon as well as local offences and stopped, discharged or withdrawn charges.

If a request for a pardon is approved, the applicant’s criminal file is eradicated from the CPIC. Therefore, whenever a criminal record verification is performed the pardoned record will not register. The Solicitor General of Canada maintains the ability to disclose information on former pardoned crimes. This takes place rarely – 99% of people pardoned continue to manifest all of the qualities of law-abiding citizens. Nevertheless, if the Solicitor General of Canada believes that a pardoned person’s behaviour is a threat to Canadian citizen or communal security he may choose to reveal particulars of pardoned crimes. Individuals who receive a pardon must confirm that they had a criminal record for which they have accepted a pardon. March 23, 2011 — Today, I rise in the House of Commons to speak about my Private Member’s Bill, C-620, the Fairness for Victims of Violent Offenders Act. I would like to use my time to reinforce the reasons why this bill would help recalibrate the balance between the rights of violent offenders and the rights of their victims, but first, and most importantly, I would like to share with the House why I worked to bring this bill forward. Like many hon. members, I have received calls from constituents over the years expressing concern that our system, in their opinion, seemed to give more weight to the rights of those convicted of very serious and heinous crimes rather than the victims of those crimes. Short Sale – Do You Qualify For a Real Estate Short Sale?

When do you know if a short sale is the best option for you? Here in New York, where I hold my broker’s license, Mahopac Real Estate has seen an exploding number of short sales. However, short sales are not for everyone. Let’s talk about the process and what you need to qualify.

Why would any bank or mortgage holder agree to a short sale? Because, banks are not in the business of owning and managing real estate. They are in the business of lending money and having real estate owned (REO) on their books negatively affects their credit rating with the Federal Reserve, hindering them from borrowing money and at a good rate. Moreover, it is less costly for a bank to accept less than originally agreed upon than to incur the expenses of selling the home at auction or worse, not being able to sell the home at auction and having to hold on to the property until it sells on the open market. Believe me, the last thing they want to do is foreclose.

How does a short sale affect your credit? Someone online once made a perfect analogy to explain the difference between how a short sale affects your credit versus how a foreclosure affects your credit. She said that one is like getting hit by a car while the other is like getting hit by a mac truck. Some say that there is no difference between the two, as far as credit is concerned. In my experience, you can recover a lot quicker from having a short sale on your credit report compared to a foreclosure. Some people have reported drops of 200 points after the former and a 300 point drop after the latter. Even if the point drop is about the same, other people have reported being able to purchase a home again two years after a short sale, whereas, after a foreclosure you can forget about buying another home for at least 7 years.

If you owe more than your home is worth, many people think right away that a short sale is an option for them. Just because you owe more than your home is worth is not reason enough. More importantly the bank must see that you are experiencing a financial hardship and are unable to pay the monthly payment amount. If you are on time with your payments, it is unlikely that the mortgage holder will grant you permission to sell the home for less than you owe and pardon you of the amount not covered by the sale. They would rather you continue to make the monthly payments.

Now, you have decided that a short sale is the best option for you, you have proved your financial hardship and the mortgage holder allows you to pursue a short sale. You then must go through the same process of selling your home as anyone else. You preferably list with an agent or broker, as opposed to selling on your own, since your situation needs more special attention and expertise than normal.

Keep in mind that you are still expected to make your mortgage payments during the “for sale” period and the short sale process can take 6 months to a year. Congress is working to pass legislation to force the banks to respond in a more timely fashion but as for now the process is still a long one and requires a ton of patience.

Once you have found a buyer, you must then go back to the bank and see if they will accept the amount that was agreed upon between you and the buyer. In a short sale situation, things get tricky because you are now, effectively, negotiating with two other parties, not just a buyer. The bank will then send someone out to obtain a BPO, or broker’s price opinion. They will base their decision on this BPO and whether they believe they are getting a fair price for your home. Obviously, the bank is already losing on the deal because they are accepting less than they were promised, so they definitely do not want to lose more on the deal by accepting less than the current market value.

One advantage, if any, to take away from this situation is that you do not have to worry about paying the broker’s commission or bank fee. The price that the bank accepts from the buyer will cover all expenses and fees. While in negotiations with the bank and the buyer, the bank will often give the broker a number that they have to walk away with after the commission and all fees have been covered.
