Understanding Oklahoma Expungement Laws

The negative impact of criminal record can last far beyond the trial and sentencing. A history of arrest, criminal charges, and conviction carry a stigma that can make ordinary tasks-like being accepted into college or finding a good job-nearly impossible. Many people don’t realize that arrest records are still available even if they were not convicted or if their sentences were deferred. In order to have those records cleared in Oklahoma, one needs to petition the court for an expungement.

An expungement is the legal process of having criminal records sealed from public view. In many counties in Oklahoma, a motion to expunge is filed in the criminal case; however, in Oklahoma County, a petition for expungement is filed in civil court. An Oklahoma expungement lawyer can help the client petition the appropriate court to have his or her record sealed.

Under Oklahoma law, there are two types of expungements. The most common type is Title 22 O.S. 991c of the Oklahoma Statutes. This type of expungement allows the sealing of one’s court record after the completion of a deferred sentence following a plea of guilt or no contest. While this removes the defendant’s name from the court docket and from public records, it does not completely eliminate his or her association with the charge. The criminal history remains on file with the Oklahoma State Bureau of Investigation (OSBI). A 991c expungement has no impact on the arrest record with the OSBI.

The second type of expungement is more desirable to those seeking to have their records cleared, but it is also more difficult to obtain. Title 22 O.S. 18 allows for not only the sealing of court records from public view, but also for the purging of arrest records, including those in the OSBI’s criminal history records. In order to be eligible for a 18 expungement, the petitioner must meet one of ten criteria:

• The person has been acquitted.
• The conviction was reversed and the charge was dismissed.
• Factual innocence was proven through DNA evidence after the conviction.
• The person has received a full pardon from the Governor.
• No charges were filed after the arrest, or charges were dismissed within one year of arrest.
• The statute of limitations on the offense expired, and no charges were filed.
• The person was a juvenile (under 18 years old) at the time the offense was committed, and he or she has received a full pardon.
• The offense was a misdemeanor, and ten years have passed since judgment with no further misdemeanors or felony charges in the meantime.
• The offense was a nonviolent felony, the person has received a full pardon, and ten years have passed with no other felony or misdemeanor charges or convictions.
• The person was arrested or charged with a crime that was committed by someone else using that person’s name or ID without consent.

Even if one qualifies under 991c or 18, an expungement is not guaranteed. The OSBI can object to an expungement if they feel that maintaining a public record of the criminal history serves the public interest more than it hinders the individual who is petitioning for expungement. For this reason, and to ensure proper petitioning procedures under Title 22 O.S. 19, it is important for anyone seeking to clear his or her arrest record or history of criminal charges and convictions to seek the assistance of an experienced Oklahoma expungement attorney with a proven record of helping clients successfully clean the slate. Now I’m looking into getting an expungement to clear up my record, even though I don;t have any convictions on it and I want to know if an expungement will clear up my arrest record as well, or if it is just meant to clear up a record of convictions?

Driving Record – Understanding the Point System

The point system for each state varies, but there is a general rule of thumb one can utilize in order to stay on top of their driving record. The points added for violations can be more severe when operating a commercial motor vehicle in comparison to your own personal vehicle. A good guideline to use is figuring that the points for a CMV will equal one and a half times the normal point system for a personal auto. For example, in Missouri, if you are caught speeding excessively in your personal car, you will receive 3 points against your driving record. If caught while driving a commercial motor vehicle, you could figure that the number would increase to 4.5 points.

Generally, there are variations to how many points a driver will receive for a speeding violation, based on the excessive miles per hour over the limit. A standard guideline is as follows:

Speeding – MPH over not specified = 2 points
1-10 MPH over = 3 points
11-20 MPH over = 4 points
21-30 MPH over = 6 points
31-40 MPH over = 8 points
More than 40 MPH over = 11 points

Other violations can also wreak havoc on your CDL:

Reckless driving = 5 points
Inadequate brakes = 4 points
Following too close = 4 points
Improper lane change = 3 points
Railroad Crossing violation = 3 points
Failure to yield/stop = 3 points
Other minor moving violations = 2 points

While each trucking company has their own hiring policies, on the average, trucking companies require that a new driver employee have:

NO failed or refused drug or alcohol test within the last 3 years
NO reckless driving convictions within the last 3 years
NO license suspension for points within the last 3 years
NO more than 3 moving violations within the last 1 year
NO more than 4 moving violations and/or accidents within the last 3 years
NO felony convictions within the last 7 years
NO controlled substance violations within the last 7 years
NO DWI, DUI, BAC or open container violations within the last 3 years
NO incarceration within the last 5 years
NO misdemeanors involving dishonesty, theft or fraud – these are considered immediate, disqualifying events

Serious, major driving offenses can cause you to lose your CDL for various periods of time. These types of offenses include DUI and DWI, either in the form of alcohol or drugs, refusing to take an alcohol test, leaving the scene of an accident, using the CMV to commit a felony, driving a CMV with a suspended license and causing a fatality through negligent driving. Any of these offenses can cause you to lose your CDL for life.

Serious traffic violations such as speeding 15 MPH or more over the speed limit, reckless driving, improper lane change and following too close, can lead to severe consequences as well. For a second offense, you could receive a 60 day suspension, and a third violation could result in a 120 day suspension. Violating an out-of-service order will result in a 90 day suspension. Violating it a second time will bring a one year suspension and a third time will result in a minimum of 3 years.

Keep in mind, that if a CDL is suspended, the state cannot issue a conditional or hardship license. If you are convicted of a driving violation, even if it is in your personal vehicle, you must notify your employer and any points you receive will also go against your CDL. These new rules went into effect on September 30th, 2005.

According to the Federal Motor Carrier Safety Administration, a few of the guidelines for disqualification of a CDL is:

1st traffic violation = 60 – 120 days suspension
Two or more violations within a 3 year period = 90 days to 5 years
One or more violation of an out-of-service order within a 10 year period = 1 year
DUI, Leaving the scene of an accident, use CMV to commit felony = 3 years
Any of the 1 year offenses while operating HazMat = LIFE

Safety and moving violations are taken very seriously for those who are licensed to operate a CMV. As you can see, it would not take much to reach 4-5 points on your driving record, professional or personally. One speeding ticket and failing to stop at a stop sign, could bring you 7.5 points on your CDL and you could find yourself out of a job. These same violations in your own personal vehicle could result in 5 points on your regular driver license – and could delay you from receiving your CDL for quite some time.

The point system for each state varies, but this general format will give you a good idea on the various points one can accumulate against their driving record.

Understanding your faith in God and His promises is extremely important for your salvation and continuation in this life. Before we start I want to ask you some questions.

1. Do you believe in the Promises of God?

5. Do you look for your prayers to be answered?

6. Are you praying in the will of God?

8. Do you get disappointed when God doesn’t answer your prayers? Our faith is based on Believing that God is and that He is able to deliver on His promises.

Many wonder why Gods acceptance of us into Heaven is based on;

1. Believing on Him.

2. Accepting His Son Jesus as Lord and Christ. and

3. Living the life that God directs us in by the guidance of the Holy Ghost. First we must look at our justification. Justification is Gods act making a sinner righteous before Him by His grace, received through the faith given to the person by God, for Christ’s sake, because of his life, death, and resurrection.

No sacrament or any church ritual is at all relevant in this matter; (in other words mans idea of being justified before God has little effect on the salvation of man,(Churches doctrine and rituals cannot justify.)

Having peace with God, gives us the blessings of the Father, through His Son, and He acquaints us as being a Child of His. We then are given the Titles and Status as, Kings and Priests before Him.

Romans 10:17; So then faith cometh by hearing, and hearing by the word of God.

We see in Romans 10:17 how faith comes, by hearing Gods word preached, but faith in God brings about a faith in the reality of Satan and His legions as well. Yes as we believe in God, we also gain a belief in Satan as well. Why? When we believe in God, we also believe in His instructions on dealing with this other side of mankinds life, unrighteousness. The Bible teaches us how to rebuke and control the evil elements that are sent against the righteous, by Satan, to destroy our Faith in God.

From evil comes all the bad sides of man, rape, theft, murder, etc. Why does God declare that even the sociable individual must believe? Lets look at; Romans 9:21, Hath not the potter(God) power over the clay(Mankind), of the same lump to make one vessel unto honour, and another unto dishonour? (The acceptance of one and the rejection of another.) Isaiah 64:8, “But now, O Lord, thou art our Father; we are the clay, and thou our potter; and we all are the work of thy hand.”

This passage is preceded in Isaiah by one declaring “the depravity of man;” Isaiah 64:6, “We are all as an unclean thing, and all our righteousnesses are as filthy rags; and we all do fade as a leaf; and our iniquities, like the wind, have taken us away.”

Barnes states; As they were polluted with sin, as they had transgressed the Law of God. The passage in Isaiah proves that God has the right of a sovereign over guilty individuals; that in Jeremiah, that he has the same right over nations; thus meeting the whole case as it was in the mind of the apostle.

These passages, however, assert only the right of God to do it, without affirming anything about the manner in which it is done. He refers to man as fallen and lost. His argument is this: “Man is in ruins: he is fallen; he has no claim on God; all deserve to die; on this mass, where none have any claim, he may bestow life on whom he pleases, without injury to others; he may exercise the right of a sovereign to pardon whom he pleases; or of a potter to mould any part of the useless mass to purposes of utility and beauty.”

When Jesus died, we all fell into the same lump, the same category, the same unrighteousness. There were none good nor justified. God granted us all a chance at life everlasting in Heaven, but with the stipulation that we believed in His Son and Honored His word. As the prophets stated, God will not inter-fear with mans life as one who rejects His offer, but at the end of a mans life, God promises him that he will be judged on his works, weather they be good or evil. Without acceptance of Jesus as Lord and Christ, mans works become evil and will be judged as such.

, condemning him to life everlasting in the Lake of Fire. In this life, do you not have the right to do what ever you desire with the things you possess? You car, money, home, etc. When a man comes in and steal from you, don’t you require him to pay for his theft, and if someone enters into your family and kills one, done you require his life as restitution? If so, then God also requires payment for His Sons death and sacrifice.

There is no difference. Now the answer to the questions is this. It should have been ,”Yes.” to all. 2Co 13:5 Examine yourselves, whether ye be in the faith; prove your own selves. Know ye not your own selves, how that Jesus Christ is in you, except ye be reprobates?

Number 8. Do you get disappointed when God doesn’t answer your prayers? WE all do at times because we are still in the flesh. God understands.

How can administrative officials be above the law? Attorney Guo Lianhui: According to the law, the CCP should not have promised Lai’s clemency, after extraditing him back to China. Because there were so many people sentenced to death and so many high-level officials involved in the case, if the CCP indeed carries out such a promise, it will indicate that China is not governed by the rule of law. The clemency came into effect from July 14. Prime Minister Sheikh Hasina yesterday defended the presidential clemency to ABM Biplob saying that he was a political victim of BNP-Jamaat coalition. Biplob, however, is in Laxmipur District Jail as he received a life sentence in two other murder cases. The Divisional Speedy Trial Tribunal of Chittagong on December 9, 2003 condemned five people including Biplob to death for kidnap and murder of Nurul Islam. Nine others were sentenced to life and two to five years in jail in the same case. On September 18, 2000, advocate Nurul Islam, Laxmipur BNP’s the then organising secretary, was abducted and then hacked dead. His body was sliced into pieces and dumped in the river Meghna. The tribunal in its verdict acquitted 15 of the 31 accused. Abu Taher, the then general secretary of Awami League’s Laxmipur district unit, and his wife Nazma Taher were among the acquitted. However, Biplob surrendered before the tribunal on April 6 this year after absconding for over 10 years. Abu Taher then appealed to the president for his son’s life.
